The FBRC editorial team continues its analysis of the privatised plots located within the group of lakes Maly Taldykol, and their owners. We have already examined who owns some plots north of Syganak Street, at the 'Mechta' Shopping Centre. In this part, we will continue to tell you about the owners of the coastal areas south of Syganak Street, opposite the 'Zelyony Kvartal' residential complex.
In this area, twelve plots (with a total area of 37.3664 hectares) have belonged to JSC MC SEZ 'Astana - Technopolis' (other transport and forwarding activities) since August 2020 on the basis of temporary paid long-term land use rights.
The land use term for five plots (with a total area of 19.0485 hectares), owned by JSC MC SEZ 'Astana - Technopolis', is due to expire in December 2026. These are plots 21-320-135-5398, 21-320-135-5298, 21-320-135-5299, 21-320-135-5300 and 21-320-135-5301.
The sole shareholder of JSC MC SEZ 'Astana - Technopolis' is JSC 'SPK Astana', which is wholly owned by the Akimat of Astana.
JSC SPK 'Astana' also owns plot 21-320-135-4824 (area 2.0914 hectares) since July 2021 on the basis of temporary paid long-term land use rights for the construction of a residential complex with commercial premises and a car park.
As lawyer Shyngys Temir previously stated, these territories will later be subleased to development companies. It was also noted that special tax and other benefits often apply for companies participating in the SEZ.
We have already been able to observe numerous violations in the activities of SPK. This refers, in particular, to JSC 'SPK 'Shymkent'. Previously, the Anti-Corruption Agency of the Republic of Kazakhstan conducted an external analysis of corruption risks in the activities of JSC 'SPK 'Shymkent' for 2019-2021.
As a result of the analysis, risks were identified related to the sale of land plots provided for the implementation of 'investment projects', housing construction, failure to take appropriate measures to stabilise prices for socially significant food products, and the improper activities of the Corporate Fund.
Moreover, it was established that land was sold without an auction, which restricts competition and violates the principles of interaction between business entities and the state. Furthermore, SPK retained profits from the money obtained from the sales without transferring them to the local budget.
The analysis showed that over three years, the Akimat of Shymkent transferred state property to SPK in the form of 70 land plots with a total area of over 200 hectares and a cadastral value of 2 billion tenge. Under joint activity agreements between SPK and business entities, 29 plots of land with an area of 36.7 hectares were sold for a total of 5.89 billion tenge. However, only 1 billion tenge was transferred to the Akimat for these lands. It is noted that there were cases where land was sold into private ownership for 10% of the appraised value.
Furthermore, on 2 September 2021, JSC 'SPK Shymkent' actually took over the hippodrome in payment for shares which it itself issues. The transaction amount was valued at 70 million tenge. So it turns out that SPK is taking the hippodrome from the State Institution 'Comprehensive Sports Club for National and Equestrian Sports of Shymkent' in payment for its own shares.
In that case, it is unclear what the purpose of competitive procedures, the Land Code or elementary competition is. We assume that no one will be surprised if it suddenly turns out that such a scheme has been used in the capital for a long time.
Plot 21-320-135-754 (area 0.3000 hectares) has been privately owned by the already known LLP 'SAT-NS' since August 2021 for the construction and operation of a petrol station. The founder of the LLP is Gabit Satvaldiev.
Satvaldiev also appears in LLP 'Sat Group Construction'. This LLP owns plot 21-320-135-4772 (area 0.8891 hectares) in this area since June 2021 under temporary paid long-term land use rights for the construction of a multi-apartment residential complex with built-in premises, a kindergarten, a polyclinic and a car park.
Incidentally, Gabit Satvaldiev is the brother of the Akim of the Turkestan Region, Darkhan Satybaldy. Another brother, Sunqar Satvaldiev, owns LLP 'Sat Group Project'. This company is also involved in the development of the Maly Taldykol lakes. However, according to the Akim himself, the Satvaldievs' business is in no way connected with Mr. Satybaldy's official position.
Nearby is plot 21-320-135-5169 (area 2.3000 hectares), owned by LLP 'Cynosure' since July 2022, under temporary gratuitous land use rights for the construction of a medical, health and physiotherapy complex. The first head of the LLP is Aidar Sauranbaev, the founders are Oleg Romashko, Andrei Kulikov, Sabir Askarov, Kurbanqul Elubaeva.
LLP 'Beren-En' owns plot 21-320-135-4823 (area 0.5000 hectares) since May 2021 under temporary paid short-term land use rights for the construction of a sports complex. The land use term expires in April 2026. The first head of the LLP is Sayat Intabaev, the founder is Bakytgul Toktamyssova.
According to Kompra.kz, since August 2023, LLP 'Beren-En' has been listed as an unfair supplier for Samruk-Kazyna procurement due to providing inaccurate information and/or false information in the tender application or price proposal.
Furthermore, as a result of an unscheduled inspection of one of the facilities, it was found that LLP 'Beren-En' carried out construction and installation work without notifying the authorised body, for which it was fined approximately 53 thousand tenge in December 2022.
Plot 21-320-135-4720 (area 1.2620 hectares) has belonged since January 2022 to LLP 'Construction&Building Solutions' under temporary paid long-term land use rights for the construction of a residential complex with service facilities and commercial premises. The land use term ends in April 2026. The first head of the LLP is Aidos Issagulov, the founder is Azat Ibadullaev.
In September 2022, LLP 'Construction&Building Solutions' was brought to administrative responsibility in connection with failure to comply with an order from the State Institution 'Department for Control and Quality of the Urban Environment of Astana'. Specifically, the LLP continued work without a technical inspection of the reliability of the structures, for which it was fined more than 300 thousand tenge.
Plot 21-320-135-5417 (area 1.2000 hectares), located south of Syganak Street, opposite the 'Zelyony Kvartal' residential complex, has belonged to LLP 'Bozgildar' since December 2021 under temporary paid short-term land use rights for the construction of a kindergarten. The first head and founder is Inkar Nadirbekova.
LLP 'Intergrant' owned a large plot 21-320-135-4617 (area 36.4477 hectares) from June 2015 under temporary paid long-term land use rights for the construction of a complex of individual residential houses. Although the land use term expired in December 2024, according to a resolution of the Akimat of Astana, the actual end date of land use was 13 September 2021. According to the Kompra.kz service, the first head of the LLP is Ksenia Gadelshina, the founder is Magomed Imadov.
Plot 21-320-135-4874 (area 3.2000 hectares) has belonged to LLP 'Binom Education' since May 2022 under temporary gratuitous land use rights for the operation of a secondary school. The land use term expires in November 2027. The first head of the LLP is Arailyim Magzumova, the founder is the private company 'General Contractors Group LTD', owned by the private company 'BI Group' and LLP 'BI Capital'.
In the period from October to December 2021, LLP 'Binom Education' carried out construction and installation work without submitting a notification of commencement of such work to the authorised body. The notification of the start of construction and installation work was submitted by the LLP only at the end of December 2021.
However, a representative of the LLP explained in court the decision to start work by stating that the facility (the school) is of particular social importance and delays to the schedule would have been unacceptable. It was decided to discontinue the proceedings.
LLP 'Rn Holding' owns plot 21-320-135-5817 (area 0.7900 hectares) since August 2022 under temporary paid short-term land use rights for the construction of the special pre-school correctional educational institution 'Demeu'. The first head and founder is Ergali Raimkulov.
It is also necessary to note the fact that Kulginov once socialised with major oligarchs. Perhaps it was at such 'off-site' meetings that the issue of developing Maly Taldykol was decided.
