The court of the West Kazakhstan Region ordered the individual entrepreneur to refund money to students of the online marketplace school.

In the West Kazakhstan Region (WKR), the court considered a claim on behalf of 21 consumers who paid for online school courses for training marketplace managers. 

The claim was filed by the Department of Trade and Consumer Rights Protection for the West Kazakhstan Region against two individual entrepreneurs (IEs) providing paid educational services.

WHAT COMPLAINTS DID THE CONSUMERS RAISE

The case materials indicate that the consumers were provided with inaccurate and incomplete information during the provision of services.

Specifically, guarantees of employment, the availability of paid internships, and the issuance of certificates were claimed. Upon review, the court found that the training did not deliver the promised results, including employment or paid internships.

Furthermore, contracts and terms of service were only provided after payment and were drawn up in one language. In the court's opinion, this made it difficult for consumers to understand and assess the terms of the contract.

WHAT VIOLATIONS DID THE COURT FIND

The Specialised Inter-District Economic Court of the WKR, having examined the case, concluded that:

  • the IEs' advertising did not correspond to the actual quality of the services provided;
  • the contracts contained provisions limiting the liability of the service providers and infringing on consumer rights;
  • the violations were of a significant nature and called into question the legality of executing the contracts for paid services.

The court noted a breach of requirements for transparency and good faith in the provision of educational services.

THE COURT DECISION

Based on the established circumstances, the court ordered the termination of 21 contracts for the provision of paid educational services.

From the two IE defendants, in favour of each of the 21 consumers, the following was awarded:

  • 490,000 tenge — the amount paid for training;
  • 20,000 tenge — compensation for moral harm.

In total, payments are provided in favour of all 21 claimants.

The court decision has not entered into legal force.
