In the North Kazakhstan Region, the prosecutor's office restored the state's financial interests by securing the recovery of 11.2 million tenge in insurance payments from a contractor who improperly fulfilled obligations under government procurement contracts for the capital repair of schools.
VIOLATIONS IN GOVERNMENT PROCUREMENT
During an inspection of compliance with legislation in the field of government procurement, it was found that the customer — the education department of the Shal akyn district — had not taken measures to recover property damage caused by the contractor during the implementation of contracts for the capital repair of secondary schools.
GROUNDS FOR RECOVERY
The contractor provided voluntary civil liability insurance contracts as security for the performance of obligations. Court rulings from 2023–2024 confirmed the facts of the contractor's improper fulfilment of contractual obligations.
ACTIONS OF THE PROSECUTOR'S OFFICE
Despite the court decisions, the customer for a long time did not seek recovery of the insurance sum, which violated Article 43 of the Law of the Republic of Kazakhstan "On Government Procurement". Following a prosecutor's supervision order, the insurance payments were recovered in full through judicial proceedings.
