The Prosecutor’s Office of the North Kazakhstan Region (NKR) has identified systemic violations of teachers’ labour rights relating to the non-payment of legally mandated compensation. This concerns travel expenses for compulsory professional development courses, which were not paid to education workers in two districts of the region.
WHAT VIOLATIONS WERE IDENTIFIED BY THE PROSECUTOR’S OFFICE
In the course of analysing compliance with labour legislation, the prosecutor’s office found that the education departments of the Taiynsha and Ualikhanov districts had violated the requirements of the Labour Code of the Republic of Kazakhstan.
Specifically, in breach of Article 52 of the Labour Code of the Republic of Kazakhstan (“Grounds for termination of an employment contract at the initiative of the employer”), 215 teaching staff were not paid travel expenses related to attending professional development courses. The total amount of unpaid funds amounted to 22.3 million tenge.
WHAT MEASURES HAVE BEEN TAKEN
As a result of the prosecutorial supervision, the guilty officials have been held accountable in accordance with the procedure established by law. To date, 128 workers have already been paid 10 million tenge.
Work to restore the violated labour rights of the remaining teachers continues. The materials do not specify the timeframe for full repayment of the debt.
REGIONAL OUTCOMES
According to the supervisory body, since the beginning of this year, the prosecutor’s office has protected the labour rights of 160 workers in various sectors. Education was one of the industries where the most significant violations were recorded.
The Prosecutor’s Office of the NKR states that work is ongoing to ensure legality and prevent violations in the sphere of labour relations.
