The Astana prosecutor's office inspected compliance with legality in the organisation of convicts' labour in penal enforcement institutions.
WHAT VIOLATIONS WERE IDENTIFIED
Facts of untimely payment of wages and incorrect drafting of individual employment contracts were established. Cases of convicts working beyond the norm provided for by labour legislation were also identified - more than 12 hours per day.
HOW THEY WERE REMEDIED
Under a supervisory order, 13 convicts were paid for overtime work in accordance with Article 108 of the Labour Code of the Republic of Kazakhstan (“Payment for Overtime Work”).
WHO WAS PUNISHED
Responsible officials for violating the requirements on remuneration of labour were brought to administrative responsibility under Article 87 of the Administrative Offences Code of the Republic of Kazakhstan (“Violation of Requirements on Remuneration of Labour”). Information on the type and amount of punishment has not been specified.
