The Senate of Kazakhstan returned the bill on stray animals to the Mazhilis for revision. At the same time, the provision on the killing of stray animals remains in the document — the changes concern the procedure for its application. The FBRK editorial team explains which specific provisions are proposed to be amended and why.
WHY THE UNIFORM PERIOD WAS REMOVED
The decision to return the bill resulted from discussions involving deputies, state bodies and the public, as well as an analysis of received submissions.
One of the key provisions stipulated a minimum period of keeping stray animals — 5 days, after which killing was permitted if rehoming had not taken place. The senators proposed abandoning a uniform approach and amending this provision.
DECISIONS HANDED TO REGIONS
Instead of a uniform provision, the Senate proposed transferring powers to maslikhats. At the local level, the periods for keeping animals, the procedure for capture, and the conditions under which killing is permitted will be determined.
This approach assumes that regulatory parameters will be set taking into account the situation in each region and the available resources.
WHY THE LINK TO CHIPS WAS REJECTED
Another reason for revision is the approach to defining stray animals. Previously, it was proposed to consider the presence of a chip as the main criterion. The senators proposed changing this provision: the key indicator is the absence of an owner.
During the discussion, it was noted that mandatory chipping within a short period could be difficult, especially in rural areas. According to the senators, the new wording will allow avoiding difficulties in enforcement.
TERMINOLOGY HAS ALSO CHANGED
It is proposed to exclude the term “euthanasia” from the document and use the phrasing “killing”.
WHAT THIS MEANS
Taking into account the proposed amendments, the bill provides for the transfer of some powers to the regional level, excludes certain wording that raised questions during the discussion, and retains provisions related to regulating the number of animals.
The further fate of the document depends on the decision of the Mazhilis, which will consider the changes introduced by the Senate.
