A court in Almaty has ordered the construction company «Alem Qurylys AQ» to carry out compensatory planting of 2,200 trees after the environmental management department discovered the felling of green spaces on the site of a future polyclinic in the Bostandyk district. Previously, the contractor had undertaken to ensure the preservation of green spaces that were not subject to demolition.
According to Bes.media, in February the Almaty Construction Department and «Alem Qurylys AQ» signed a contract for the construction of a polyclinic with a capacity of 500 visits. The documents recorded the presence of 51 green spaces, including the English oak, which is a rare species and under threat of extinction.
In April, specialists from the department discovered the illegal felling of 43 trees on the construction site. Following this, the department went to court demanding that the client and contractor be ordered to carry out compensatory planting.
During the court proceedings, representatives of the construction department and the contractor stated that the fact of the felling by the contractor had not been proven, and that the inspection report of the green spaces "does not contain the seal of the authorised body or the signature of the defendant's representative".
However, the court indicated that the inventory and forest pathology survey materials confirm the existence of the disputed plantings as of 2024, and that the contractor, upon accepting the site, had assumed obligations for their preservation.
"The absence of the types and number of trees and shrubs in the report is considered an omission on the part of the party accepting such circumstances, i.e., the Limited Liability Partnership. The parties do not dispute the current absence of the disputed plantings," the court ruling states.
In the end, the court took into account the circumstances of the felling and ordered LLP «Alem Qurylys AQ» to carry out compensatory landscaping.
"To oblige LLP «Alem Qurylys AQ» to carry out, taking into account the requirements of current legislation, measures for the compensatory restoration of green spaces by planting 2,200 seedlings on public land, ensuring subsequent care for three years," the court decision states.
Recall that earlier, the editorial office of the FBRK received information about systematic violations in the Shubar microdistrict of the city of Astana. The owners of the Urbo car wash, located at 58A Kosmonavtov Street, illegally expanded the parking area at the expense of public land, thereby destroying green spaces and creating a safety risk for local residents.
