Community activist Serik Baigaliyev helped uncover violations of transport legislation, called officers from the transport control inspectorate for the Abai region to prepare paperwork regarding heavy goods vehicles, but afterwards an administrative protocol was also drawn up against him. The court later discontinued the case due to the absence of a constituent element of an offence.
HOW THE ADMINISTRATIVE CASE AROSE
According to Hronika.kz, the head of the branch of the NGO "Centre for Supporting the President's Policy on Combating Corruption", Serik Baigaliyev, sent an appeal to the Minister of Transport Nurlan Sauranbayev, his deputy, and the chair of the Committee for Transport Control.
The appeal states that at the end of June 2026, the activist, together with police officers, took part in a preventative operation to identify lorries which, according to his information, were violating the requirements of transport legislation.
After such vehicles were identified, officers from the transport control inspectorate for the Abai region were called to the scene to carry out control weighing. It is reported that the inspectors drew up administrative paperwork not only against the owners of the heavy goods vehicles, but also against Serik Baigaliyev himself.
WHY THE COURT DISCONTINUED THE PROCEEDINGS
A protocol was drawn up against the activist under Part 1 of Article 462 of the Administrative Offences Code of the Republic of Kazakhstan ("Obstruction of the lawful activities of an official"). The materials were referred to the Specialised Court for Administrative Offences of the city of Semey.
The court discontinued the proceedings due to the absence of a constituent element of an administrative offence. As set out in the appeal, the court stated that Serik Baigaliyev is not a subject of state transport control, and that the inspectorate officers did not have the authority to draw up a protocol against him under the said article.
WHAT REQUIREMENTS WERE SENT TO THE MINISTRY
After the conclusion of the court proceedings, Serik Baigaliyev approached the leadership of the Ministry of Transport. In his appeal, he requests that an internal investigation be conducted into the officials involved and that their dismissal be considered.
Furthermore, as stated in the materials, appeals have also been sent to law enforcement agencies. According to the activist, he is asking for a legal assessment of the actions of the officials.
CONTEXT
The practical application of legislation in the sphere of transport control has more than once been the subject of inspections and public debate.
In January 2026, the FBRK editorial team examined in detail the operation of the weight control system and automated measuring stations (AMS). An analysis of documents, official responses from government bodies and statistics showed that after the launch of automatic issuance of orders through the Unified Register of Administrative Proceedings (URAP), prosecutorial authorities began reviewing some administrative proceedings linked to the operation of certain AMS units. At the same time, cases were identified where orders were issued in respect of vehicles which, according to the materials reviewed, could not have been the subjects of such violations.
Later, official responses from JSC "NC "KazAvtoZhol", the Committee for Road Transport and Transport Control and LLP "Automatic System" showed that responsibility for the various stages of AMS operation is distributed among several parties. "KazAvtoZhol" is responsible for the procurement and installation of the stations, but does not have access to data on violations and fines, while the committee receives information from the AMS units but is not involved in the selection of contractors.
Problems in the operation of the transport control system have been raised not only by carriers, but also by the agency's own staff. In October 2025, the chief specialist of the transport control inspectorate for the Zhambyl region, Nursultan Bulatbekov, reported to FBRK on a corruption scheme in the capital's transport control structures - according to him, the leadership of certain departments protected violators in exchange for monthly kickbacks from heavy goods vehicles.
