The manufacturer of armoured vehicles Aibek Barys was found guilty of insulting entrepreneur Marat Yesimseitov and sentenced to 60 hours of community service. On appeal, he was released from punishment due to an amnesty.
HOW THE CONFLICT BETWEEN THE ENTREPRENEURS AROSE
According to the Telegram channel “Kozachkov offside”, the private prosecution case was heard by the courts of Astana after several months of proceedings. Both parties to the conflict work in the military sphere.
On the evening of 25 December, Aibek Barys called Marat Yesimseitov and then sent him three audio messages on WhatsApp containing obscene language. According to the case materials, a misunderstanding had previously arisen between the entrepreneurs, but they had met and spoken on the phone to sort out the situation.
WHAT THE EXPERT EXAMINATION ESTABLISHED
According to the expert's conclusion, the audio messages contained numerous obscene expressions. Yesimseitov decided to have the recordings certified by a notary and to apply to court to protect his rights.
WHY THE VICTIM WENT TO COURT HIMSELF
The case was heard as a private prosecution. Yesimseitov filed the complaint with the court himself, since insult cases are not investigated by the police.
Aibek Barys did not admit guilt. He stated that the sending of messages from his subscriber number does not in itself prove that he was the one who sent them.
HOW THE PROCEEDINGS ENDED
The court found Barys guilty and sentenced him to 60 hours of community service. However, the appellate instance released him from punishment due to an amnesty. The sentence entered into legal force.
In respect of the lawyers Timur Ayten and Magamed Khanayev, the court issued a private ruling.
