The Prosecutor's Office of the Talas District in the Zhambyl Region has uncovered a case of illegal sale of municipal property.
According to the regional prosecutor's office press service, in 2008, the management of the state-owned utility enterprise «Igilik» sold a production facility to third parties for 270 thousand tenge without holding a tender. The estimated value of the facility was 30 million tenge.
Then, in 2022, the owner pledged the property as collateral to obtain a loan from a microcredit organisation.
On this basis, the district prosecutor's office launched a pre-trial investigation against the former head of the enterprise under Part 4 of Article 362 of the Criminal Code (exceeding official authority). However, as a result, the criminal case was closed due to the expiration of the statute of limitations for the committed crime.
At the same time, the economic court of the Zhambyl Region granted the akimat's claim to invalidate the purchase and sale and pledge agreements.
«The appellate instance, on 22.05.2024, upheld the decision of the first instance. The judicial act has entered into legal force, and the property has been fully returned to the state», the statement reads.
