The prosecutor's office has uncovered violations in the work of the land commission of the Sandyktau district of Akmola region when allocating agricultural land. Failure to comply with the statutory deadlines for competitive procedures called into question the transparency of their implementation and became grounds for the cancellation of lease agreements.

WHAT THE VIOLATIONS INVOLVED

According to the materials of the supervisory authority, when reviewing applications and summing up the results of the competition for the right to temporary paid land use (lease) of land for farming and agricultural operations, deviations from legal requirements were permitted.

It was established that the results of the competition were summed up in three stages, whereas current regulations stipulate that results should be summed up the day after the competition is held. The materials state that this failure to meet deadlines affected the transparency and objectivity of the competition procedures.

COURT DECISION AND ITS CONSEQUENCES

Following a prosecutor's supervisory act, the state body for control over the use and protection of land had 7 lease agreements declared invalid by a court. As a result, agricultural land with a total area of 1,400 hectares was returned to state ownership.

LIABILITY OF OFFICIALS

For the violations committed, officials were held to administrative responsibility. The materials do not specify which exact measures were applied or which specific individuals were involved.
