The administration of the Serebryakovskaya Secondary General Education School in Uralsk has filed a lawsuit to recover overpaid salaries from 75 teachers, totalling more than 42 million tenge.
According to the press service of the Supreme Court, the lawsuit was filed based on a state audit conducted at the school.
Following the inspection, the investigative authority opened a criminal case against the school’s chief accountant, who was later found guilty and given a sentence.
"As part of the criminal case, the state audit of the school revealed financial violations involving the unjustified transfer of salaries amounting to 42 million tenge, resulting in the creation of accounts receivable for the salaries of 75 teachers for the years 2021-2022", the statement said.
In court, representatives of the school administration were unable to provide evidence that could confirm the teachers had committed any unlawful actions.
Ultimately, Court No. 2 of Uralsk dismissed the school’s lawsuit.
"In the absence of bad faith towards work on the part of employees or an accounting error, as defined by labour and civil legislation, there are no grounds for recovering the amount", the ruling stated.
It is worth recalling that in September, in the Burabay district of the Akmola region, a court refused the education department's claim against three rural school teachers to recover allegedly unjustly accrued salaries.
