The court rejected the claim by officials to recover teachers' salaries in the Akmola region.

A court in the Burabay district of the Akmola region has considered a case brought by the education department against three rural school teachers for the recovery of allegedly unjustifiably accrued salaries.

According to the press service of the regional courts, an audit commission had previously found that between 2021 and 2022, the teachers had been unjustifiably paid salaries.

"On this basis, the audit commission issued an order to the department: to eliminate the identified violations, to take disciplinary action against those responsible, and to reimburse the incorrectly paid sums to the budget income", the statement reads.

In executing the order, the education department imposed disciplinary sanctions on the accountants and an economist.

Furthermore, the department asked the court to recover sums ranging from 66,000 tenge to 616,000 tenge from the defendants. However, the court found no grounds for doing so.

"The sums paid constitute part of the salary, which is not subject to recovery, given that the teachers acted in good faith. The department did not conduct an official investigation into the facts specified in the order, did not take disciplinary measures against the defendants, and did not provide the court with evidence of bad faith on the part of the defendants", the court's ruling states.

In the end, the court dismissed the education department's claim against the teachers for the recovery of the sums. The decision has entered into legal force.
