The Prosecutor General's Office has reported that illegal court rulings have been challenged. In 2024, the Supreme Court reviewed 50 rulings in response to the office's protests, 38 of which were in favour of the state totalling 12.3 billion tenge.
According to the press service of the Prosecutor General's Office, for example, LLP «SK» undertook to build two residential complexes in Talgar under public procurement contracts, but did not complete the construction within the established deadlines. As a result, the company was ordered to pay a penalty and was refused an extension of the contract.
In another case, following a protest by the Prosecutor General, the obligation imposed on the Military Institute of the Ministry of Defence to accept from LLP «A.E.S» a simulator unsuitable for training and to pay 1.1 billion tenge was deemed unjustified.
It has become known that last year prosecutors upheld 12 protests in the interests of citizens and business entities who were unable to appeal court rulings on their own.
For example, at the Regional Perinatal Centre of the Karaganda Region, a local woman's internal organ was damaged during an operation. She can no longer lead a normal life and is forced to change her job. As a result, the medical institution was ordered to pay the victim material damages of 33,814 tenge and compensation for moral harm of 3 million tenge.
Also, the Prosecutor General's Office lodged a protest in the interests of LLP «K.A.S», which built a kindergarten under a contract with the Almaty construction department. Despite the fact that the acceptance and commissioning of the facility were delayed due to the client's fault, the client succeeded in having the contractor declared an unscrupulous participant in public procurement and in claiming a penalty. The Supreme Court dismissed the client's claim and upheld the protest of the Prosecutor General.
