The Specialised Interdistrict Economic Court of Almaty has ordered the management of the Hotel Kazakhstan to reconstruct the fountain located on its adjoining grounds. Previously, instead of restoring the fountain, hotel representatives built a swimming pool there.
According to the press service of the Supreme Court, the Almaty Urban Planning Control Department demanded that the hotel enforce the order, but no action was taken.
The department then filed a lawsuit, citing the hotel's violation of the Law "On Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan".
"The LLP carried out reconstruction of the fountain on the grounds adjacent to the Hotel Kazakhstan. It carried out work without design and estimate documentation and an expert opinion, and without supervision by the author and technical supervisors. But instead of the planned reconstruction of the fountain, construction of a swimming pool was started," the statement said.
It was also noted that the construction and installation work on the swimming pool was carried out without the necessary permits.
Incidentally, the aforementioned fountain is located within a protected zone, which includes the hotel building, listed as a monument of local history and culture in Almaty.
As a result, the court, considering all the circumstances, upheld the claim and forced the client to comply with the department's order. The court decision has not yet entered into legal force.
For context, it was previously reported that the owner of the hotel is LLP "Crown Star". It was reported that the authorities conducted an inspection of the hotel back in April following complaints from residents. The Akimat demanded that the owner cease work and rectify the violations. In May, a request was sent to the prosecutor's office of the Medeu District to hold the LLP accountable.
