JSC "Turkestan International Airport" has been brought to administrative responsibility for violating antimonopoly legislation: the company charged entrepreneurs a fee for the right to sell aviation fuel on the airport's premises. The violations were identified by the department of the Agency for the Protection and Development of Competition for the Turkestan Region (APDC), and the court imposed an administrative fine of 14.3 million tenge.
COURSE OF THE INVESTIGATION
The department of the APDC conducted an analysis of the state of competition in the retail aviation fuel market. Based on its findings, it was established that JSC "Turkestan International Airport" held a dominant position and imposed additional obligations on entrepreneurs not related to the subject of the agreements.
NATURE OF THE VIOLATION
According to the investigation, the company charged business entities a fee for the right to sell aviation fuel on the airport's premises. The department classified these actions as a violation of subparagraph 4) of Article 174 of the Entrepreneurial Code of the Republic of Kazakhstan ("Abuse of a dominant or monopoly position").
COURT DECISION
The Specialised Inter-district Administrative Offences Court of Turkestan found JSC "Turkestan International Airport" guilty and imposed an administrative fine under Part 3-1 of Article 159 of the Administrative Offences Code of the Republic of Kazakhstan ("Monopolistic activity") in the amount of 14.3 million tenge.
It is worth recalling that on 19 February, the department of the APDC of the Republic of Kazakhstan completed an investigation against LLP "Semey International Airport". The court brought the company to administrative responsibility for abusing its dominant position in setting high prices for aviation fuel and imposed a fine of 8.8 million tenge with confiscation of income of 8.5 million tenge.
