Airport Semey fined 8.8 million tenge for monopolistically high aviation fuel prices

The Department of the Agency for the Protection and Development of Competition of the Republic of Kazakhstan (APDC RK) has completed an investigation into Semey International Airport LLP, during which an abuse of a dominant position was established through the setting of a monopolistically high price for aviation fuel. The court found the company guilty and imposed an administrative fine with confiscation of income.

HOW THE CONFLICT DEVELOPED

During the investigation, the Department found that the airport had abused its dominant position by maintaining a high price for aviation fuel in retail sales. The violation falls under subparagraph 1) of Article 174 of the Entrepreneurial Code of the Republic of Kazakhstan (“Abuse of a dominant or monopoly position”).

The case was heard in the Specialised Inter-district Administrative Offences Court of Semey. The court found the company guilty and imposed an administrative fine of 8.8 million tenge with confiscation of monopoly income in the amount of 8.5 million tenge.

The company's appeal was considered by the Judicial Panel for Criminal Cases of the Abay Region Court, which upheld the ruling. The court decision has now entered into legal force.

REGULATOR'S RESPONSE AND MEASURES

In addition to the fine, the Department issued an order to cease setting a monopolistically high price. Semey International Airport LLP fully complied with the order, setting a justified price for aviation fuel in retail sales.

WHAT WILL CHANGE

Before:

  • Monopolistically high price for aviation fuel;
  • Generation of monopoly income.

After:

  • Price adjusted to a justified level;
  • Confiscation of monopoly income of 8.5 million tenge.
