People who invested in shared-equity construction of the company G-Park have appealed to the Prosecutor General’s Office in Astana.
According to the media, the residential complexes they were promised — ‘Lisbon’, ‘Washington’, ‘Geneva, 2, 3’, ‘Rio de Janeiro 2’, ‘Madrid 3’, ‘Zurich’ and ‘Dublin’ — do not have commissioning permits, and some have not even been completed.
Despite the fact that G-Park has recently lost its permission to build and attract funds from equity holders, the company of former MP Gabit Satmagambetov continues to advertise and sell its apartments.
In addition to getting their money back, the equity holders are demanding that Gabit Satmagambetov’s and the company’s social media pages be shut down.
“They claim that Satmagambetov continues to advertise property, travel, live a lavish lifestyle and buy expensive items while his clients try to get justice,” the statement reads.
Furthermore, the victims are asking for G-Park’s cash desk to be closed because it is allegedly still receiving money from new investors.
It has become known that a criminal case against the developer was opened back in March. The police of the Yesil district launched an investigation, but no action has been taken on their part.
After unsuccessful appeals to the Anti-Corruption Service, the district and city prosecutor’s offices, and the Ministry of Internal Affairs, the equity holders gathered outside the Prosecutor General’s Office. According to reports, they were unable to reach an agreement there either.
Lawyer Alya Sarsenova, who represents the victims’ interests, stated that the damage caused by G-Park’s actions currently stands at 732 million tenge, but the amount could rise to 1 billion tenge. According to her, 110 people have officially filed lawsuits, and about 500 have submitted complaints and appeals.
As the lawyer explained, problems with refunds also arise because the company entered into preliminary reservation agreements with investors, rather than equity participation agreements. Moreover, the documents were signed with limited liability companies (LLCs) in which Satmagambetov was a founder, and therefore he cannot be held liable.
It is also reported that, as part of the criminal case, an independent audit is expected from a company chosen by the capital’s akimat (city administration), followed by a forensic construction examination and a judicial commission.
Additionally, it has become known that the investors plan to appeal to the Presidential Administration or record an address to President Kassym-Jomart Tokayev.
Recall that earlier, the akim of Astana, Zhenis Kassymbek, stated that the capital’s akimat had banned the company ‘G-Park’ from building new homes. The restriction will remain in place until the developer finishes constructing 12 facilities and hands over the keys to the equity holders.
At the same time, Prime Minister Olzhas Bektenov expressed concern about problematic facilities built by the company G-Park. According to him, the company is building seven residential buildings in the capital without permits. He noted that around 3,500 families have invested their funds in them.
Recall that earlier, the Executive Director of the Republican Public Association ‘Adildik Zholy’, Didar Smagulov, named the construction firm G-Park among the ‘favourites’ of former Astana akim Altai Kulginov.
Furthermore, 17 equity holders of the company G-Park, who cannot recover their invested funds, appealed to the office of the Republican Public Association ‘Adildik Zholy’.
Incidentally, the company G-Park filed a complaint with the police against Didar Smagulov for allegedly spreading false information damaging their reputation. However, they were refused the initiation of a case due to the absence of a criminal offence.
