The Astana City Court has confirmed the detention of Judge Dosayeva for drunk driving.

A judge of the Astana inter-district court for civil cases, Assel Dosayeva, was stopped on 2 November on suspicion of driving a vehicle while under the influence of alcohol. The city court confirmed the fact of the stop, but it is currently impossible to detain her administratively due to the special legal status of a judge.

According to Tengrinews.kz, during a raid, patrol police officers stopped a Mazda car. An examination showed the driver was under the influence of alcohol.

In turn, the city court confirmed the fact that Assel Dosayeva was stopped and stressed that the special legal status of judges does not exempt them from responsibility for breaking the law.

It is noted that the Ministry of Internal Affairs has sent the administrative offence materials to the General Prosecutor's Office, which will, in due course, submit a representation to the Supreme Judicial Council.

The court reminded that disciplinary procedures, issues of personnel selection, appointment and dismissal of judges fall under the exclusive competence of the Supreme Judicial Council.

At the same time, the media report that law enforcement agencies cannot yet detain Assel Dosayeva administratively.

"They cannot arrest her yet. To arrest her for 15 days for drunk driving, a number of bureaucratic procedures must be gone through — this is because she is a judge," the report states.

It is worth recalling that previously in Ust-Kamenogorsk, a prosecutor from the city prosecutor's office, Vilori Pan, was dismissed after committing an administrative offence related to driving while intoxicated.
