The akimat of the Kazybek bi district of Karaganda has been ordered to pay for the repair of two cars which were hit by a falling tree.
According to zakon.kz, the incident took place in Karaganda in the summer of 2023. The car owners took the matter to court seeking compensation.
“According to the assessment reports, the cost of restoring the cars was 634,779 tenge and 445,292 tenge. The fact that a tree fell on the plaintiffs’ cars was recorded in the incident log of the South-Eastern Police Station, and photographic records were also made,” the court reported.
It was further established that the tree was growing on a plot of land belonging to the Kazybek bi district. The court concluded that the tree should have been subject to sanitary felling, and upheld the car owners’ claim against the akimat.
“The office of the akim of the Kazybek bi district failed to ensure the proper organisation of work on the improvement and sanitary maintenance of the district’s territory, and the enforcement of norms and requirements in the field of improvement by economic entities, in accordance with the current rules. The court found no fault or gross negligence on the part of the plaintiffs, as their cars were parked in the courtyard of a residential building, and the parking rules were not violated,” the court explained.
It has been reported that the decision has entered into force.
