The Government of Kazakhstan has amended the procedure for applying the moratorium on the creation of new quasi-public sector entities. The relevant resolution was adopted on 2 March 2026. The document adjusts the rules for creating such structures in cases where the initiative comes from the President of the Republic of Kazakhstan.
CHANGES TO THE PROCEDURE FOR APPLYING THE MORATORIUM
The resolution introduces amendments to the government document of 21 August 2024, No. 678 “On the introduction of a moratorium on the creation of quasi-public sector entities”.
Previously, subparagraph 2 of paragraph 1 of the resolution provided for the possibility of creating quasi-public sector entities in special cases based on direct instructions from the President.
Under the new wording, such decisions are permitted with positive conclusions from the authorised body of the relevant industry and the antitrust authority.
Thus, the implementation of such decisions now requires confirmation from the relevant state bodies.
EFFECT OF THE RESOLUTION
The resolution was signed by Prime Minister Olzhas Bektenov and comes into force on the date of its signing.
The document clarifies the procedure for applying one of the exceptions to the current moratorium on the creation of quasi-public sector entities.
