The rules of surrogacy have changed in Kazakhstan

In Kazakhstan, the rules for providing surrogacy services have changed. Now, only citizens of the Republic of Kazakhstan who are married can be customers of such a service.

WHAT CHANGES HAVE COME INTO FORCE

According to Zakon.kz, on 14 July 2026, the Head of State Kassym-Jomart Tokayev signed the Law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on State Administration and Local Self-Government". The document, in particular, supplemented the Code "On Marriage (Matrimony) and Family" with a new norm on surrogacy.

According to the changes, only spouses who are citizens of the Republic of Kazakhstan and are married can be customers of the surrogacy service.

WHAT OBLIGATIONS ARE PLACED ON THE SPOUSES

The law establishes that the customer spouses are obliged to bear the material costs associated with the surrogate mother undergoing medical examinations and the application of assisted reproductive methods and technologies.

In addition, they must provide the medical organisation with a medical report on their physical and mental health, as well as the results of a medical-genetic examination.

The customers are also obliged to pay for the medical care of the surrogate mother during pregnancy, childbirth, and for 56 days after childbirth. If the pregnancy or childbirth was accompanied by complications, the costs are paid for 70 days after childbirth.

WHEN THE NEW RULES WILL COME INTO EFFECT

The law comes into effect on 26 July 2026, with the exception of certain provisions.
