A village woman won 18.5 million tenge from Kazpost after receiving a disability.

Kazpost JSC has been ordered to pay 18.5 million tenge to a resident of the Zhambyl region who was injured by the company’s building roof. 

According to the press service of the Supreme Court, in the spring of 2023 in the village of Asa, Zhambyl district, a strong wind tore off the roof of the Kazpost branch building, and it fell on a local resident. She was later rushed to intensive care. The woman became a Group 1 disabled person.

“The victim sustained severe bodily injuries – a closed craniocerebral injury, contusions of the brain, chest and spinal cord, an extensive scalp wound to the face and forearm, and a compression fracture of the 3rd and 4th vertebrae”, the statement reads.

It should be noted that the Zhambyl branch of the JSC immediately responded to the request of the victim’s daughter and provided assistance in the amount of 7 million tenge. However, this amount proved insufficient to cover all treatment costs, including rehabilitation abroad. 

For its part, the company’s representative did not admit the claim, explaining that the JSC had carried out roof repairs in 2021-2022, but could not provide documents regarding the repairs from its archives.

The court established that the roof collapse occurred because the alleged contractor performed the repair work poorly and did not secure the roof properly.

“The court concluded that the JSC did not ensure the proper level of safety and operation of the facility, as the JSC is responsible for the maintenance of the building and oversight of the roof’s major repairs”, the statement reads.

The court ordered that 8.5 million tenge in compensation for material damage and 10 million tenge for moral harm be recovered from Kazpost JSC.
