The Vice-Minister of Finance of Kazakhstan has been fined for failing to comply with a court decision.

Kazakhstan's Vice Minister of Finance Dauren Kenbeil has been fined 78,640 and 196,600 tenge for ignoring a private court ruling. The case relates to a dispute over public procurement, in which the court ruled in favour of the business and ordered the Ministry of Finance to rectify the identified violations; however, no report on the implementation of the measures was submitted.

How the conflict unfolded

According to the PROTENGE Telegram channel, the dispute began with a complaint from a potential supplier who disagreed with the tender documentation for the public procurement. The case was under consideration for more than six months, after which the court issued a private ruling addressed to the Ministry of Finance. The court ordered the agency to rectify the violations and report on the measures taken.

By the deadline, no response was received. The administrative court regarded this as contempt of court and failure to comply with the court order.

WHY THE CASE BECAME PERSONAL

Fines amounting to 20 and 50 MCI were imposed on Vice Minister Dauren Kenbeil, who oversees public procurement. When questioned by the court about the reasons for the lack of response, the Vice Minister did not provide a clear answer.

An attempt to appeal the fines through a lawyer representing the Ministry of Finance was rejected. The court noted that the ministry and the official are not identical, and in this case, administrative liability was placed personally on the Vice Minister, not on the agency.

In total, Dauren Kenbeil must pay the state budget just over 275,000 tenge. The materials do not specify how this will affect his future work or career.
