The punishment for using someone else's digital signature is being tightened in Kazakhstan

A new type of administrative offence for the use of an electronic digital signature (EDS) by another person comes into force in Kazakhstan.

According to the press service of the Ministry of Digital Development, Innovation and Aerospace Industry, previously administrative liability was only provided for the illegal transfer of an EDS key to third parties and the failure of the registration certificate holder to take measures to protect it.

"After the amendments come into force, both the person who transferred the EDS and the person who used it will be held liable," the statement said.

The ministry explained that the time limit for bringing to liability for administrative offences in the areas of personal data protection and EDS has been increased from two months to one year from the date of commission.

In addition, for violations of the law on personal data and its protection, expressed in the illegal collection, processing of personal data and failure to comply with measures for its protection, the amount of administrative fines has been tripled.

Previously, fines ranged from 10 MCI (39.3 thousand tenge) to 1000 MCI (3.9 million tenge) depending on the nature of the offence. They will now range from 30 MCI (117.9 thousand tenge) to 2000 MCI (7.8 million tenge).

It is noted that these measures are aimed at strengthening the protection of personal data, ensuring the security of EDS use and increasing liability for violations in the field of informatisation.
