A person with a disability was awarded compensation for poor-quality prosthetics in Shymkent.

The Interdistrict Civil Court of Shymkent has recovered material damages and compensation for moral harm from a public association of disabled people. The court established that the prosthetics provided to the plaintiff were of inadequate quality and quickly became unusable, which hindered mobility and daily life.

SUBSTANCE OF THE DISPUTE

The plaintiff, a disabled person of the second group, had been receiving a leg prosthetic from the public association of disabled people for over 12 years. In 2025, she was issued a new prosthetic and an additional prosthetic, but both devices became unusable within two months. The case materials state that the prosthetics were not of adequate quality, which hindered mobility and created problems in daily life.

COURT DECISION

The court took into account that the plaintiff would require a quality prosthetic for a full life and ruled to recover material damages in the amount of 1,064,000 tenge. In addition, considering the psychological and moral distress caused by the poor-quality items, the court awarded compensation for moral harm in the amount of 1,000,000 tenge.

The court's decision has entered into legal force. The claim was partially satisfied.
