The American company New Balance filed a claim in the court of the Zhambyl region against a local entrepreneur for compensation for the illegal use of trademarks.
According to the press service of the regional courts, the claimant holds the exclusive rights to this trademark.
The foreign company became aware that the defendant was using the trademark without consent in their online store on the "Kaspi.kz" app.
"The claimant placed an order for the goods from the defendant, which is confirmed by the fiscal receipt, photos, and a video recording of the purchase, thereby confirming the fact that the defendant sold counterfeit goods", the statement says.
Having studied the case materials, the court took steps to reconcile the parties, after which the parties entered into a settlement agreement.
Under the terms of the agreement, the defendant admitted the claim for 100 thousand tenge: part of the compensation in the amount of 73 thousand tenge and costs for documenting the violation - 27 thousand tenge. The entrepreneur was also obliged not to use the claimant's trademarks.
In turn, the American company waived compensation in the amount of 296 thousand tenge. The court terminated the proceedings, returning the state duty to the claimant.
