The former director of the Aisulu garment factory, which was showcased to President Kassym-Jomart Tokayev in 2022, and the former deputy of the Taldykorgan maslikhat, Zharylkasyn Bolatuly, has been sentenced to 6 years and 8 months in prison for fraud.
WHAT THE COURT ESTABLISHED
According to Hronika.kz, the court found that Zharylkasyn Bolatuly attempted to sell his private house in Almaty for 120 million tenge, knowing that the property was located on the so-called "red line" and had several encumbrances related to the non-fulfilment of financial obligations.
Furthermore, according to the case materials, the court established the fact of document forgery for this house with the aim of reselling it.
WHAT DECISION THE COURT MADE
By the verdict of the District Court No. 2 of the Medeu District of Almaty, Zharylkasyn Bolatuly was found guilty under paragraph 2 of part 4 of article 190 of the Criminal Code of the Republic of Kazakhstan ("Fraud").
The court sentenced him to 6 years and 8 months in prison, to be served in a medium-security penal facility.
The court also ordered that the time spent in custody and under house arrest be counted towards the sentence in accordance with Article 62 of the Criminal Code of the Republic of Kazakhstan. Additionally, a compulsory payment of 20 MCI — 78,640 tenge was recovered from the convicted person for the Victim Compensation Fund. Civil claims from the victims were dismissed due to compensation for the damage caused.
The verdict has not yet entered into legal force. This means it can be appealed in accordance with the procedure established by law.
WHAT IS KNOWN ABOUT THE FACTORY AND THE DEPUTY STATUS
The Aisulu garment factory was opened in Taldykorgan in 2022 and fulfilled state orders for sewing special clothing for employees and staff of state bodies. In autumn 2022, the enterprise was showcased to President Kassym-Jomart Tokayev.
As reported by the chairman of the Taldykorgan maslikhat, Temirbolat Akhazhan, after the start of the pre-trial investigation, Zharylkasyn Bolatuly submitted an application to the territorial election commission to resign his deputy powers. He is currently no longer a deputy.
