The Kostanay City Court examined a civil case concerning a local resident's claim against a developer for compensation for material damage caused by flooding of the premises.
According to the press service of the Kostanay Region courts, in October last year, the basement premises were flooded, as a result of which the plaintiff suffered material damage amounting to more than 2 million tenge.
"According to the response provided by the State Municipal Enterprise 'Kostanay-Su', an inspection of the basement revealed that a tee piece not meeting the standards had been installed on the internal drainage networks," the statement said.
In response to the pre-trial claim, the Association of Property Owners (APO) stated that the engineering structures and networks, including the sewerage system, had not been accepted from the developer.
"In August 2024, a representative of the developer accepted a defect report indicating deviations from the project in the construction, however, these violations have not been rectified," the court noted.
Guided by the fact that the developer put the residential building into operation with violations, the court upheld the citizen's claim and ordered the defendant to pay the amount of damages and court costs totalling 2,587,000 tenge.
Recall that previously, residents of the "Adam Armany" residential complex in Astana reported widespread violations by the developer and a lack of building management. Despite the fact that apartments were purchased back in 2022, many residents are still unable to sign contracts with utility services. The residential complex was marketed as "comfort-class", but in reality does not even reach the level of "economy-class".
