Senator Andrey Lukin has stated that there are violations of investors' rights and administrative barriers in the implementation of investment projects in Kazakhstan.
According to him, the Land Resources Management Committee of the Ministry of Agriculture (MoA) unreasonably refuses to approve investment contracts, and there are also delays in the allocation of land and connection to engineering infrastructure.
HOW THE CONFLICT DEVELOPED
As reported by МIА "Kazinform", the deputy noted that the Land Resources Management Committee of the MoA refuses to approve projects for investors, citing inconsistencies with detailed planning schemes or land categories.
At the same time, according to the senator, the norms of urban planning legislation establish that the main document is the general plan, and adjustments to detailed plans are possible after the conclusion of an investment contract.
VIOLATIONS IN THE WORK OF STATE BODIES
Andrey Lukin emphasised that violations continue after the signing of investment contracts:
- akimats do not meet the deadlines for reviewing applications for land plots and concluding lease agreements;
- refusals to consider applications and delays in providing engineering infrastructure are being recorded;
- the state corporation "Government for Citizens" makes unreasonable demands when registering acts for commissioning facilities;
- natural monopoly entities sometimes refuse connection to networks;
- there are instances of illegal administrative prosecution of investors.
PROBLEMS WITH INVESTOR SUPPORT
The senator noted that the Investment Committee formally performs functions according to the "one-stop shop" principle, but does not analyse the reasons for delays and often makes decisions on unilateral termination of contracts. Since 2024, it was planned to terminate 26 investment contracts due to lengthy procedures, infrastructure problems, and, according to the agencies, the investors' fault.
SENATOR'S PROPOSALS
To address the identified problems, Lukin proposed:
- to stop the practice of terminating contracts when there are objective reasons for delays;
- to strengthen control over the implementation of investment projects;
- to provide for the availability of infrastructure or its installation when concluding investment contracts.
