Amendments to education legislation are being considered in Kazakhstan

The Majilis of the Parliament has begun discussing two bills that introduce amendments to the Law "On Education", the Law "On the Status of a Teacher", and the Code of Administrative Offences (CAO RK). The amendments affect the organisation of the educational process, the legal status of teachers, and the distribution of responsibility among participants in educational relations.

CHANGES TO SCHOOL REGULATION

One of the bills introduces amendments to the Law "On Education".

In particular, the procedure for using mobile phones in secondary education institutions will be approved by the authorised body in the field of education. Previously, the relevant rules were determined at the level of the institutions themselves.

It is also proposed to clarify the procedure for the transfer and reinstatement of students in pedagogical specialities. A separate transfer procedure is established for the "Pedagogical Sciences" field, including transfer from foreign universities, subject to participation in the competition for an educational grant funded by the republican budget.

In addition, the concepts of "network schools", "hub school", and "affiliated school" are introduced and clarified, and the concept of academic honesty is established.

TEACHERS' RIGHTS AND ADMINISTRATIVE RESPONSIBILITY

The second bill provides for amendments to the Law "On the Status of a Teacher" and the CAO RK.

In the Law "On the Status of a Teacher", it is proposed to enshrine the right of a teacher not to maintain personal or image-related social media accounts at the request of the administration.

It is also prohibited to demand reports or information not provided for by legislation in the field of education, as well as the simultaneous maintenance of documents in paper and electronic formats.

The amendments to the CAO RK provide for administrative liability for involving teachers in types of work not related to their professional duties. The amounts of fines are specified depending on the category of the subject.

DISTINCTION OF RESPONSIBILITY

The draft amendments to the Law "On the Status of a Teacher" clarify the limits of responsibility for teachers and heads of educational institutions. According to the proposed wording, they bear responsibility for incidents involving students exclusively during the period of carrying out their professional activities.

It is separately established that parents or other legal representatives bear responsibility for the child's behaviour and safety outside of school hours.

ADDITIONAL PROVISIONS

The bill also stipulates that educational institutions that have undergone international accreditation are exempt from state attestation for the duration of the accreditation, but for no more than five years.

CURRENT STATUS

At present, the bills are under consideration in the relevant committees of the Majilis.
