President Kassym-Jomart Tokayev has signed the Law "On the Prevention of Offences", which changes the state's approach to maintaining public order. For the first time, the document introduces the concept of anti-social behaviour and creates an early response system for risks of violations. The law focuses on preventive work through explanations and social support, rather than on punishments.
The new law establishes a system for early response to potential offences. For the first time, the concept of anti-social behaviour is introduced into Kazakhstani legislation. The document explicitly states that no fines or other sanctions are envisaged for such manifestations, unless they constitute an offence. The main tools become explanatory work, official warnings, as well as social and rehabilitation assistance. This approach allows work on the causes, rather than on the consequences.
Earlier, on 18 December, the Senate approved the new framework law and a package of amendments to the Code of Administrative Offences. The document consolidates the norms of five previously existing laws and forms an updated prevention system.
The provision banning the wearing of clothing that conceals the face in public places deserves particular attention. This measure is preventive in nature and is aimed at identifying citizens, which aids in the detection and prevention of crimes. However, the law provides for exceptions: medical reasons, professional necessity, weather conditions, and cultural and sporting events. A warning is provided for a first violation.
The law is also focused on preventive work with vulnerable groups of the population and high-risk situations. Particular attention is paid to the area of domestic and family offences. The emphasis is on early intervention and support for families in difficult life situations.
The adopted law creates a legal basis for a system of early prevention of offences. The new prevention system is aimed at the timely identification of risks and the provision of support to people in vulnerable situations, which should help strengthen public safety.
