Akimats of Kazakhstan have been granted the right to fine for littering in public places

From 2 March 2026, local executive bodies have been granted the right to draw up administrative reports for littering public places. This refers to rubbish discarded on streets, in parks and public gardens, as well as the storage of municipal waste in unauthorised locations.

WHAT CHANGES HAVE COME INTO FORCE

Amendments have been made to Article 804 of the Administrative Code of the Republic of Kazakhstan. According to the amendments, the right to draw up administrative reports under Article 434-2 of the Administrative Code of the Republic of Kazakhstan ("Littering of public places") has been granted to the akimats of Astana, Almaty, Shymkent and all regions of the country.

The amendments came into force on 2 March 2026. Previously, only police officers could draw up reports under this article.

The expansion of powers means that not only law enforcement agencies but also local executive bodies will be able to record violations.

Now, akimats can initiate liability for:

  • rubbish discarded on streets;
  • littering parks and public gardens;
  • storing municipal waste in unauthorised locations.

WHAT FINES ARE PROVIDED

According to Article 434-2 of the Administrative Code of the Republic of Kazakhstan, administrative measures are provided for littering public places:

First violation:

  • a fine of 10 monthly calculation indices (MCI)

  or

  • community service of up to 40 hours.

Repeat violation within a year:

  • a fine of 20 MCI

    or

  • community service of up to 80 hours.

HOW MANY VIOLATIONS WERE RECORDED PREVIOUSLY

According to the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan, in 2025 more than 591,000 people were held liable for similar offences.

Of these:

  • over 189,000 — for littering public places;
  • more than 403,000 — for violating landscaping rules.

The total amount of fines imposed was 5.2 billion tenge.
