The prosecutor's office of the Baizak district has uncovered violations in the reclassification of agricultural land, which resulted in mandatory payments of 49.6 million tenge not reaching the budget. The officials responsible have been subjected to disciplinary action.
WHAT IS KNOWN
The prosecutor's office of the Baizak district inspected compliance with land legislation requirements in the activities of the State Institution "Department of Land Relations of the Baizak District Akimat".
As a result of the inspection, violations were identified in the reclassification of agricultural land plots. When they were redesignated for the servicing of residential houses, buildings, and structures, the authorised body failed to ensure the assessment and collection of payments for compensation for losses of agricultural production, as required by the Land Code of the Republic of Kazakhstan.
HOW ONE PLOT BECAME LINKED TO THE DEBT
One of the identified cases involved the reclassification of an irrigated land plot covering 5.7 hectares. The corresponding decision was made by the akim of the Ulgilinsky rural district.
The land user was obliged to compensate for losses of agricultural production in the amount of 7.5 million tenge. However, this sum was not paid within the time limit prescribed by law.
HOW MUCH MONEY DID NOT REACH THE BUDGET
During the inspection, the prosecutor's office identified a further 5 similar instances. In these cases, mandatory payments totalling 49.6 million tenge did not reach the budget.
These are payments that should be levied when agricultural land is redesignated for other purposes in cases provided for by land legislation.
HOW MUCH HAS ALREADY BEEN RECOVERED
As a result of the prosecutorial supervision order, 35 million tenge has been recovered. The officials responsible have been subjected to disciplinary action.
Currently, the authorised bodies are taking measures to recover the remaining amount of the debt.
