The former vice-president of JSC «KazTemirTrans» Azamat Kapenov had his terminal at «Dostyk» station confiscated. A court in Astana ordered the property to be forfeited to the state as part of an investigation, in which the company’s damage is estimated at more than 5.2 billion tenge.

WHAT THE COURT DECIDED

According to the Agency for Financial Monitoring (AFM), the General Transport Prosecutor’s Office filed a motion for pre-trial confiscation of the terminal at «Dostyk» station.

By a ruling of the Inter-District Criminal Court of Astana, this property has been forfeited to the state. The measure was taken to compensate for the damage caused and to recover illegally acquired assets.

WHAT AZAMAT KAPENOV IS SUSPECTED OF

According to the investigation, Kapenov, using his official position, ensured illegal preferences for affiliated companies in the provision of freight wagon operating services.

The investigation claims that as a result of these actions, JSC «KazTemirTrans» suffered damage amounting to over 5.2 billion tenge. A pre-trial investigation is being conducted against Kapenov on suspicion of abuse of office and embezzlement of funds.

WHAT IS THE PROCEDURAL STATUS OF THE CASE

The AFM reported that Azamat Kapenov has been placed on the international wanted list. The court authorised a pre-trial restraint measure of detention in absentia.

The investigation is ongoing, and further information is not disclosed in accordance with Article 201 of the Criminal Procedure Code of the Republic of Kazakhstan.

CONTEXT

Azamat Kapenov is the former vice-president of JSC «KazTemirTrans». He was previously married to the daughter of the former head of the National Security Committee (KNB) Karim Massimov, Tamilla Karim.

According to media reports, he may be located outside Kazakhstan — in particular, possible presence in the United Arab Emirates (UAE) has been mentioned.

It was separately reported that Kapenov appears in search databases also in the Russian Federation (RF). Furthermore, his brother — Meder Kapenov — is listed in the search database of the Ministry of Internal Affairs (MIA) of the RF.

In Moscow, Azamat Kapenov owned mansions worth more than 6 billion tenge. Meder Kapenov owns a flat with an area of 234 m² in central Moscow.
