HOW THE SITUATION UNFOLDED
It was established that the head of a department at the Syrdarya District Office was absent from work due to an administrative arrest. He had been in custody for 15 days for an administrative offence.
To conceal his absence, the civil servant submitted a sick note to his superiors, attempting to explain his absences.
HOW THE FORGERY WAS DETECTED
During the pre-trial investigation, it was determined that the submitted document was fictitious. According to the prosecutor's office, it was produced by a doctor at the Syrdarya District Hospital.
Based on the materials from the prosecutor's inspection, an investigation was launched, which was subsequently referred to the court.
THE COURT'S VERDICT
The court found the doctor guilty under Part 1 of Article 385 of the Criminal Code of the Republic of Kazakhstan (“Forgery of a document”). The sentence imposed was restriction of liberty for a term of 1 year.
The head of department was found guilty under Part 3 of Article 385 of the Criminal Code of the Republic of Kazakhstan (“Use of a knowingly forged document”). He was ordered to pay a fine of 20 MCI (86,500 tenge).
The verdict has entered into legal force.
