In Aktobe, after a tooth extraction, a 13-year-old girl developed complications that required two operations. The court awarded 4 million tenge in moral damages from the clinic's founder.
HOW THE SITUATION DEVELOPED
According to Hronika.kz, on 11 February 2025, the girl and her parents went to Dr "Disikush" dental clinic. Doctor Akbota Itemgenova extracted the child's 26th tooth. After the procedure, the girl developed swelling on the left side of her jaw and had difficulty opening her mouth.
A week later, an X-ray was taken at the same clinic. The examination showed that the tooth root had not been completely removed and had ended up in the maxillary sinus. The remaining root was removed by another doctor at the clinic — Berikbay Sapakov.
WHAT THE INSPECTION ESTABLISHED
An inspection by the regional department of the Committee for Medical and Pharmaceutical Control established that after Sapakov's intervention, the canal in which the root had been located remained open. Food got into it, which led to repeated inflammation.
A few days later, the girl developed weakness and an abscess. The parents went to hospital, after which the child underwent two operations in the maxillofacial surgery department. Subsequently, doctors diagnosed chronic osteomyelitis.
The inspection also established that Itemgenova had not confirmed the complete removal of the tooth and had not performed a follow-up X-ray of the socket after the procedure. According to the experts' conclusion, Sapakov's intervention required being carried out in an inpatient setting and a specialised department.
WHAT VIOLATIONS WERE IDENTIFIED AT THE CLINIC
In addition to the circumstances of the treatment, the inspection revealed problems with licensing. At the dental clinic, medical activities were carried out without the necessary annexes to the licence for outpatient and polyclinic care for children, including consultative and diagnostic care and radiology.
In court, the medics did not admit their guilt. They claimed that they had acted correctly and attributed what had happened to the parents' negligence.
WHAT THE COURT DECIDED
The court sided with the girl's parents and awarded from the clinic's founder — Ai-Altyn LLP — 4 million tenge in favour of the child as compensation for moral damages.
The decision has not entered into legal force.
