A court in the Akmola Region has declared the results of a competition for the organisation of hot school meals in the city of Atbasar invalid. The basis for this was the discovery of false information about employees, which had been submitted by the winner in the competition documentation.
WHAT WAS THE SUBJECT OF THE DISPUTE
According to the Telegram channel «HALYQSTAN», the Specialised Inter-District Administrative Court considered a claim filed by an individual entrepreneur against one of the schools in the city of Atbasar, challenging the results of the competition for providing students with hot meals.
Two suppliers participated in the competition. A farming enterprise was declared the winner. The entrepreneur, who disagreed with the outcome, pointed to the possible absence of an employment relationship between the enterprise and the employees whose details had been submitted in the documents.
WHAT THE COURT ESTABLISHED
During the proceedings, the court verified the data concerning four cooks whom the farming enterprise had declared as its employees.
The court established that one of the women listed in the documentation had in fact never worked for the enterprise. Another witness stated that she had previously performed the duties of a cook, but no employment contract had been concluded with her. The whereabouts of the other two employees could not be determined.
Additional requests from the court to JSC «UAPF» and authorised bodies showed that pension contributions had not been made for these individuals. Furthermore, information regarding the registration of employment contracts in the Unified System for Recording Employment Contracts was absent.
WHAT DECISION THE COURT MADE
Based on the evidence gathered, the court concluded that the competition participant had provided false information and used forged documents.
By the court's decision, the protocol on the results of the competition was annulled. Thus, the results of the competition for organising school meals were declared invalid.
WHAT MATERIALS WERE SENT TO THE PROSECUTOR'S OFFICE
In addition, the court issued a special ruling addressed to the prosecutor's office of the Akmola Region. The supervisory authority will now be required to provide a legal assessment of the actions of the head of the farming enterprise.
This concerns circumstances related to the possible use of forged documents, as well as the personal data of citizens without their consent.
