A minor suffered serious injuries after being electrocuted on the territory of a railway station. The court held his guardian administratively liable for failing to properly fulfil duties of upbringing and ensuring the child's safety.
WHAT THE COURT ESTABLISHED
The Specialised Inter-District Juvenile Court of Kostanay Region reviewed a case of an administrative offence against B. under Part 1 of Article 127 of the Administrative Code of the Republic of Kazakhstan (“Failure to fulfil duties of upbringing and (or) education, protection of rights and (or) interests, and measures to ensure the safety of a minor”).
The court established that B., as the guardian of the minor V., born in 2010, did not ensure the proper fulfilment of duties of upbringing and ensuring the child's safety.
WHAT HAPPENED AT KOSTANAY STATION
On 25 June 2026 at approximately 21:00, the minor was on the territory of the Southern Railway Yard of Kostanay Station. According to the case materials, he climbed onto a train carriage that was under a contact wire in order to take a photograph.
As a result of electrocution, the child sustained serious bodily injuries, including third-degree burn shock covering a total area of 60%, as well as contused wounds to the nose and tongue.
COURT DECISION
During the court hearing, B. fully admitted his guilt. He explained that he had been the guardian of his nephew since the death of the child's mother.
The court found B. guilty of committing an administrative offence and imposed an administrative penalty in the form of a fine in the amount of 43,250 tenge.
The decision has not entered into legal force.
