The Specialised Criminal Court has begun hearing the case concerning an attack on a police officer in Kostanay. At the preliminary hearing, the court established the identities of the three defendants and set a date for the main trial.
WHO IS INVOLVED IN THE CASE
According to the publication ‘Kostanay News’, appearing before the court are Ruslan Pasechnik, Amir Damiруly and Ainur Armanuly. Two of the defendants are 21 years old, while the third is 25 years old.
At the preliminary hearing, the prosecutor read out the bill of indictment, which sets out the prosecution's version of the circumstances of the incident.
WHAT VERSION THE PROSECUTION PRESENTED
According to the indictment, the incident occurred on 28 March at approximately 8:30 am in the courtyard of building No. 60 in the ‘Bereke’ neighbourhood. According to the prosecution's version, a Kostanay police department officer, Ruslan Kaziyev, who was in uniform, reprimanded a group of young people who were in the courtyard.
According to the indictment, during the conflict Ruslan Kaziyev was struck several times, after which he fell and lost consciousness. Experts found that he had sustained a closed head injury, concussion and numerous haematomas. According to the medical report, these injuries correspond to minor harm to health.
UNDER WHICH ARTICLE THE CHARGE HAS BEEN BROUGHT
The criminal case has been opened under Part 6 of Article 380 of the Criminal Code of the Republic of Kazakhstan (“Threats or violent acts against a representative of authority, committed by a group of persons”). The penalty provided for is 10 to 15 years' imprisonment.
The final legal assessment of the defendants' actions is to be made by the court.
WHY THE CASE IS BEING HEARD WITHOUT A JURY
The judge, Olga Shangina, explained to the defendants their right to have the case heard with the participation of a jury. All three waived this right.
Following this, the court set a date for the main trial.
Earlier, the cassation court toughened the sentences of three residents of the Atyrau region who had been found guilty of using violence against representatives of authority. Instead of restriction of liberty, they were sentenced to imprisonment.
The incident occurred on 3 April at approximately 10:00 pm in the Makat district of the Atyrau region. According to the investigation's version, a group of men offered resistance to police officers while they were carrying out their official duties. One of the officers sustained bodily injuries of moderate severity.
