The state body was ordered to pay 34.8 million tenge to the family of a deceased employee in Petropavlovsk

In Petropavlovsk, a court has ordered a state body to pay more than 34.8 million tenge to the family of a deceased tax service employee.

According to the press service of the courts of the North Kazakhstan Region, after the tragic death of the official, his widow, who is raising three minor children, approached the state body requesting a one-time benefit payment, but was refused.

Officials cited a lack of funding and the need to coordinate the matter with other authorities.

The widow filed a lawsuit in court, demanding the recovery of more than 58 million tenge. The claimed amount was calculated based on all types of income the husband had received over the last 12 months.

The Court No. 2 of Petropavlovsk, having examined the case materials, established that the deceased's family's right to a one-time benefit is enshrined in legislation.

«According to subparagraph 1 of paragraph 5 of Article 20 of the Law of the Republic of Kazakhstan 'On Taxes and Other Mandatory Payments to the Budget', in the event of the death of an official of tax authorities while performing official duties, his family or dependents are paid a one-time benefit in the amount of ten years' salary based on the last position held. The payment is made from budget funds,» the statement said.

At the same time, the court applied an analogy of law. Since the deceased did not have a special rank or title, the amount of monetary allowance was determined only on the basis of the official salary.

As a result of the consideration of the claim, the decision was made partially in favour of the plaintiff. The court ordered the state body to pay the widow more than 34.8 million tenge.
