In Aktau, residents of the "Alma Aparts" residential complex have been protesting for over a year against the construction of a three-storey restaurant right next to their apartments. The building is in its final stage of construction.
As reported by Lada.kz, the residents of building No. 49 claim that the businessman obtained the land for construction through an exchange for a plot in the embankment area. According to them, the Akimat did not have the right to issue such permission.
It is noted that the restaurant is being built virtually right up against the residential building. Nearby there are three schools, a college, a clinic, and kindergartens. Residents fear that there will be no room left for cars to pass, and parking will move directly into the courtyard.
Furthermore, the residents report violations of sanitary standards: there is no rubbish container and no parking spaces. At the same time, the electrical networks and sewerage are connected to the building's common manhole, placing additional strain on the utilities.
"A restaurant means not just food, but also alcohol, noise, music, and drunken groups. This will destroy our peace and quiet," the residents added.
They have sent complaints to the state architectural and construction control, the department for land resource management, and the city and regional Akimats, but construction has continued.
By taking the matter to court, the residents achieved a favourable decision at first instance, but the court of appeal sided with the businessman.
Despite numerous appeals and court proceedings, the residents continue to defend their rights and oppose the construction of the restaurant. The final decision now depends on the actions of the authorities and further judicial procedures.
