The MP criticised the new Building Code and demanded an investigation into corruption.

MP Bolatbek Aliyev sent a parliamentary request addressed to the Deputy Prime Minister of the Republic of Kazakhstan, the Prosecutor General, the Chairman of the Anti-Corruption Agency (Anti-cor), and the Chairman of the Agency for the Protection and Development of Competition (APDC). In his appeal, the MP criticised the draft Construction Code, for the development of which 363 million tenge was spent from the budget. 

On his Facebook page, Aliyev stated that instead of solving the problems of unplanned development, Kazakhstanis received a document of dubious quality, hiding many 'Trojan horses'.

'Digitalisation and information support for construction activities were presented by the developer as one of the key innovations of the bill. However, instead of this, we received a chapter consisting of just two articles containing general norms that duplicate the current Law "On Informatisation". At the same time, the authorised body did not forget to equip itself with the necessary competence to resolve its own issues.' - the MP stated.

According to him, due to changes to 3 by-laws and 1 state standard, the maintenance of executive technical documentation is now carried out only through the 'eQurylys' portal. 

The MP established from open sources that the portal was developed on the initiative of a private company, then transferred free of charge to the state's balance sheet, which in turn handed it over to the trust management of the quasi-state enterprise JSC 'KazNIISA'

However, for the platform to function fully, there is a separate service that allows documentation to be uploaded to the portal. It remains the property of a private enterprise, and to use it, you have to pay. It is reported that the price of the services starts from 50 thousand tenge and above, depending on the cost of the construction project.

'The payment is monthly and continues until the project is completed. For every road, school, clinic, kindergarten, park, and pavement being built – in short, everything financed by the state treasury – you will have to pay. That's several hundred million tenge per month!' - Aliyev fumed.

At the same time, the MP asked Deputy Prime Minister Roman Sklyar to note that it is impossible to legalise such platforms without the support of an authoritative government official. 

Based on the above, the Mazhilis MP requested: 

  • that the government present an official position regarding compliance with the norms of informatisation legislation during the implementation of the 'eQurylys' project; 
  • that measures be taken to ensure the possibility for subjects of the construction industry to upload executive documentation to state information systems free of charge; 
  • that the trust management agreement with JSC 'KazNIISA' be cancelled in order to eliminate an unproductive intermediary and ensure equal access to maintenance work on state information systems; 
  • that the Anti-Corruption Agency examine the actions of officials for signs of corruption offences; 
  • that the APDC examine the stated facts for compliance with the legislation in the field of competition protection.
