In the Pavlodar region, the prosecutor's office is pursuing the payment of child support by holding debtors to account. In January alone, three individuals were found guilty by the court of maliciously evading child support obligations, and a further seven criminal cases are under investigation.
TOUGHER MEASURES AGAINST DEBTORS
The prosecutor's office is applying various measures against non-payers: restrictions on leaving the country, administrative and criminal liability, and digital search.
SPECIFIC CASES
According to the prosecutor's office:
- One debtor evaded payments for three years, concealed income, and accumulated a debt of 2.2 million tenge for the maintenance of three young children.
- A second debtor did not pay child support for more than six years, with arrears exceeding 4 million tenge, despite being able to work.
All three have been convicted by the court under Article 139 of the Criminal Code of the Republic of Kazakhstan (‘Failure to fulfil obligations to pay funds for the maintenance of children’). A further seven criminal cases are under investigation by pre-trial investigation authorities.
THEFT AND MISUSE OF CHILD SUPPORT
- In November, the Prosecutor General's Office reported on the theft of child support by a private bailiff, who, over the course of six months, received child support payments from debtors and spent them on personal needs. As a result, 34 children suffered losses totalling 1.2 million tenge.
- At the same time, prosecutors in Almaty identified violations by a private bailiff in six proceedings related to the collection of child support.
- In May, in the Mangystau region, a bailiff forged a claimant's statement and unlawfully lifted a ban, for which he received a financial reward from the debtor.
