A private bailiff was stripped of their state licence in Almaty

Prosecutors in Almaty have uncovered violations by a private bailiff (PBF) in 6 cases related to the recovery of child maintenance. 

According to the city prosecutor's office press service, the bailiff engaged in artificial delay, groundlessly transferring cases from one region to another. 
 
Furthermore, prosecutors found instances of unlawful lifting of asset seizures, failure to take timely action to recover debts, and disregard for the demands of authorised bodies.

"Following a supervisory action by the prosecutor's office of the Alatau district, a private bailiff has been stripped of their state licence by a ruling of the Almaty City Court. The ruling has entered into legal force," the statement said.

For context, in November last year, the prosecutor's office of the Kostanay region established that bailiffs in the region were not closing enforcement proceedings against deceased debtors. This is despite the law requiring the bailiff to suspend proceedings within one working day in the event of the debtor's death.

In May of this year, prosecutors in Taraz uncovered the embezzlement of funds by a private bailiff. They transferred 3.1 million tenge collected from 46 debtors into their own account.

In September, following a prosecutor's action, 50 PBFs were subjected to disciplinary measures, and proceedings to expel one from the chamber of bailiffs were initiated. As a result of the measures taken, over 75 million tenge was recovered from debtors.

In early November, the Prosecutor General's Office reported on the embezzlement of child maintenance by a private bailiff (PBF), who for six months received maintenance payments from debtors and spent them on personal needs. Ultimately, 34 children suffered losses amounting to 1.2 million tenge.
