The family of a rescuer who died after a bus fell into a pit on the territory of JSC "Maikainzoloto" have filed a lawsuit seeking compensation for moral harm.
"The moral harm is caused by the mental suffering they endured, the severity of losing a son, father, and brother, the inability to say goodbye to him at his funeral, and the lack of condolences and support from the employer", the press service of the Ekibastuz City Court reported.
It is noted that a commission comprising the Ministry of Emergency Situations, the Akimat of Pavlodar Region, the state labour inspector, JSC "Maikainzoloto", and LLP "Republican Central Headquarters of Professional Paramilitary Emergency Rescue Services" previously conducted an investigation into the accident, the results of which established the employer's one hundred percent fault.
As a result, the court granted the claims of the mother, daughter, son and sister of the deceased rescuer and ordered the employer to pay compensation for moral harm in the amount of 30 million tenge to each of them (120 million tenge in total).
Recall that on 4 January, a bus carrying four mine rescue workers fell into a 150-metre-deep stope void near the Maikain mine. Information about the discovery of two bodies later emerged. The bodies of rescuer Aidos Shaimerden and driver Ayip Tleubergenov were only found in the summer.
