The court examined the case concerning the tragedy at the «Maikainzoloto» mine, where a bus carrying people fell into a sinkhole. The commission that conducted the investigation concluded that the fault lies entirely with the employer.
According to the «Kazinform» media agency, the company denies any blame for the incident, and its representatives tried to contest this decision in court. Ultimately, the court established that several factors caused the accident.
“These include an unsatisfactory organisation of production work, which manifested in inadequate control over the safe conduct of mining operations by the responsible persons of JSC ‘Maikainzoloto’. There was also improper monitoring of the collapse process from the workings during the extraction of blocks. Furthermore, there were no projects for the extraction of mining units during the ore body extraction.”, the statement said.
These circumstances were confirmed by the investigation materials, as well as the conclusions of expert organisations and sub-commissions.
“The accident occurred during working hours while employees of the LLP ‘RCSh PVASS’ were performing their work duties. Based on the causes of the accident, which resulted from the actions (or inaction) of the responsible persons of JSC ‘Maikainzoloto’, the claimant is found to be 100% at fault. In this regard, the court refused to satisfy the claim against the Labour Committee and the Industrial Safety Committee of the Ministry of Emergency Situations. The claim against the Industrial Safety Committee of the Ministry of Emergency Situations was filed against the improper party.”, the court reported.
It is worth recalling that on 4 January, near the shaft of the Maikain mine, a bus fell into a 150-metre deep stope void with four mine rescuers on board. Later, information emerged about the discovery of two bodies.
The search teams also found the rescuers’ bag containing a logbook and a body part of the bus with its state registration number. It was also reported that the rescuers had found a bus wheel.
In desperation, the relatives of the rescuers trapped under the rubble even invited a psychic to the site of the emergency. However, this also yielded no results - the bodies of two people remain under the collapse.
