An entrepreneur has been unable to use his land in the Turkestan Region for 11 years

The plot has been formalised, the boundary act has been drawn up, the courts have issued rulings, yet the owner has still been unable to use the land. The FBKR editorial team has already reported more than once on the story of Yergali Meirbekov from the Tolebi district of the Turkestan region. Now it has taken new turns: a confirmed measurement, a boundary that has shifted by 7 metres, and a fresh cadastral document for the disputed territory.

HOW IT ALL BEGAN

In 2011, Yergali Meirbekov acquired a plot in the village of Burgulyuk. The entrepreneur initially agreed the purchase with all the relevant authorities, established the boundaries and obtained the necessary permits, and later decided to expand his holdings by buying the neighbouring plot. Imagine his surprise when it turned out that someone else had already fenced off the land. The village akimat, as it turned out, had issued it to a third party, even though it was at the disposal of the district authorities. The district akim merely threw up his hands, calling land disputes the entrepreneur's "personal problems".

The courts ultimately confirmed that the questions surrounding the issuance of the neighbouring plot were not accidental. Its sale and purchase agreement was declared invalid: the land had been issued by the akim of the rural district, even though it belongs to the district's recreational zone. In 2023, this plot was liquidated. It would seem the road to a solution was open, but the entrepreneur was still standing at a locked door.

THE MEASUREMENT CONFIRMED THE BOUNDARIES, BUT NOT FOR LONG

In April 2025, at a reception with the district akim — at that time Yerkegali Alimkulov — the territory of the liquidated plot was ordered to be cleared and the boundaries of Meirbekov's own land established. That same month, a measurement was carried out with the participation of a lawyer from the district land relations department, which confirmed that the boundaries matched the data recorded back in 2015. 

For the first time in many years, the paperwork and reality coincided.

But already in May, before the entrepreneur's reception with the regional akim Nuralkhan Kusherov, the deputy district akim Lesbek Serikbayev approached him and asked him not to attend the reception, allegedly promising to resolve the matter at district level. However, despite all the promises, the problem was never resolved, and the entrepreneur continued to write to higher authorities. 

WHERE DID THE 7 METRES GO?

In January 2026, when establishing the boundaries of Meirbekov's plot, data was recorded which, according to his comparison with the 2025 measurement, shifts the boundary by approximately 7 metres. Several months passed, the plot remained the same, yet its boundary suddenly ended up in a different place. 

In April, at a personal reception, Nuralkhan Kusherov instructed the regional prosecutor's office to verify the facts of possible distortion of the measurement results. However, according to Meirbekov, no substantive check was ever carried out. 

WHAT IS HAPPENING AROUND THE LIQUIDATED PLOT

While the question of the boundaries remained open, events around the former neighbouring plot developed no less rapidly. 

The courts considered a claim for demolition and declared three structures on this territory illegal: the ruling came into force in February 2026.

In parallel, another chain of events was unfolding, linked to decisions by the akim of the rural district. In 2005, he adopted a decision that concerned this very territory. In 2022, the same akimat revoked it, and in 2025 a court dismissed a claim to annul that revocation. But in April 2026, the regional court approved a settlement agreement between the parties, and just a few days later the akim of the rural district revoked his own 2022 decision. As a result, the 2005 decision came back into force, 21 years later.

It turns out that over 11 years, different things have been said about the same piece of land in different years. Decisions taken by local authorities were either revoked or reinstated, and in this flurry of paperwork one person continues to suffer. An entrepreneur who has owned the plot since 2015 is paying for the land with his time, his nerves and years of litigation, yet still cannot make use of it.

The FBKR editorial team asks the prosecutor's office of the Turkestan region to pay attention to the situation and to verify on what grounds the coordinates and boundaries of the entrepreneur's plot were changed.
