The Interdistrict Criminal Court of Astana has found the directors of two property valuation companies not guilty of abuse of official power. It also issued private rulings to the head of the Financial Monitoring Agency (FMA) and the police chief for the Saryarka district of the capital.
THE DEFENDANTS AND THE VICTIM
According to the Telegram channel «HALYQSTAN», the director of Arman Tyutyukov of «Otsenka i Ekspertiza» LLP from Astana and the head of the Shymkent-based company «Independent Property Valuation» Maksat Tusipbekov were accused of abuse of official power.
The victim in the case was businessman Genrikh Bogdevich. Ten years ago, he was involved in reviving the Komsomolskaya poultry farm in the Kostanay region using funds from «KazAgroFinance» JSC. However, the project, worth 3.5 billion tenge, turned out to be a failure.
THE ESSENCE OF THE CASE
After the failure of the investment project, Bogdevich was convicted for the misuse of credit funds. Equipment and workshops of the poultry farm, built back in Soviet times, were transferred to KazAgroFinance as compensation for losses. The value of this property was precisely what Tyutyukov and Tusipbekov had assessed.
Bogdevich claimed the valuation was conducted incorrectly and that he had suffered damages amounting to 600 million tenge. The businessman repeatedly demanded that criminal proceedings be initiated against the valuers, but was consistently refused due to the lack of evidence of a crime.
However, Bogdevich's latest application was unexpectedly allowed to proceed. The case was not only opened but was also sent to court in the spring of last year.
THE COURT'S VERDICT
The Interdistrict Criminal Court of Astana fully acquitted the defendants, finding them not guilty. Tyutyukov and Tusipbekov are also entitled to rehabilitation and compensation for damage caused by their unlawful criminal prosecution.
PRIVATE COURT RULINGS
Additionally, the court demanded that the head of the FMA and the police chief of the Saryarka district hold accountable the subordinates responsible for violations of criminal procedure law.
Let us recall that in May 2025, employees of the poultry farm recorded an appeal to the country's President. The people claimed that the ongoing investigative actions since 2022, based on Genrikh Bogdevich's statements, were creating an atmosphere of tension at the enterprise and could lead to the dismissal of 225 employees.
