The Department of the Agency for the Protection and Development of Competition (APDC) in Shymkent has identified violations in the activities of JSC Social-Entrepreneurial Corporation (SEC) «Shymkent».
According to the APDC press service, an agreement was concluded between the corporation and LLP «Kazsbytgroup» for the supply of electricity to the city's industrial zones.
The terms of the agreement stipulated the transfer of more than 50% of the income of the company to the SEC. The agency regarded this as a restriction of competition.
«The requirements of Article 174 of the Entrepreneurial Code of the Republic of Kazakhstan, which prohibits entities with a dominant position from taking actions that infringe on the rights of other market participants, were violated,» the statement says.
As a result, by court decision, SEC «Shymkent» was held liable and fined 14.6 million tenge.
Recall that in March, the editorial board of the FBRK reviewed the financial statements of SEC «Shymkent» for 2023 and discovered interesting trends.
The material also includes data from an investigation by News Price regarding financial violations by SEC «Shymkent» during the chairmanship of Baurzhan Kankin - billion-tenge violations and the placement of bonds without notifying the Ministry of Finance.
